Nuon Inc. ("Nuon," "we," "our," and/or "us") values the privacy of individuals and organizations who use our Bring Your Own Cloud (BYOC) platform and deployment services (collectively, our "Services"). This privacy policy (the "Privacy Policy") explains how we collect, use, and disclose information from users of our Services ("Users") to deliver and optimize our platform. This Privacy Policy applies to our customers who use our Services and associated users who access our platform. By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Service.

Information We Collect

We may collect a variety of information from or about you or your devices from various sources, as described below.

If you do not provide your information when requested, you may not be able to use our Services to their full extent, particularly if that information is necessary to provide you with our Services or if we are legally required to collect it.

A. Information You Provide to Us

Registration and Account Information. When you create an account, sign up for our Services, request product information, or participate in our surveys or events, we may ask you for information such as your name, organization name, email address, and job title.

Platform Configuration. When you configure and use our platform, we may collect information about your cloud infrastructure preferences, deployment configurations, and application settings necessary to provide our BYOC services.

Communications. If you contact us directly, we may receive additional information about you, such as your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide. When you communicate with us online, third-party vendors may receive and store these communications on our behalf. If you subscribe to our newsletter or product updates, we will collect certain information from you, such as your email address. When we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Services.

Careers. If you decide that you wish to apply for a job with us, you may submit your contact information and your resume online through our careers portal powered by Ashby. We will collect the information you choose to provide on your resume, such as your education and employment experience. If you apply through Ashby, we will collect the information you make available through that platform.

B. Information We Collect When You Use Our Services

Location Information. When you use our Services, we may infer your general location information, for example by using your internet protocol (IP) address.

Device Information. We receive information about the device and software you use to access our Services, including IP address, web browser type, operating system version, and authentication tokens.

Usage Information. To help us understand how you use our Services and to help us improve them, we automatically receive certain usage information about your interactions with our platform, such as the pages or features you access, deployment activities, configuration changes, and timing of visits. This helps us improve the platform experience and troubleshoot issues.

Information from Cookies and Similar Technologies. We and our third-party partners collect information using cookies, pixel tags, or similar technologies. Our third-party partners, such as analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services.

Cookie Consent. We present you with a cookie consent prompt when you first visit our website. No analytics, advertising, or visitor identification technologies are loaded until you provide your consent by clicking "Accept." Your preference is stored in a first-party cookie (nuon_consent) so we can remember your choice on subsequent visits. You may clear this cookie through your browser settings to be prompted again.

• To provide, maintain, improve, and enhance our Services, including deploying and managing applications in customer cloud environments
• To personalize your experience on our platform and optimize deployment workflows
• To understand and analyze how you use our Services and develop new products, services, features, and functionality
• To communicate with you, provide you with updates and other information relating to our Services, provide information that you request, respond to comments and questions, and otherwise provide customer support
• For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable, or otherwise of interest to you
• To generate anonymized, aggregate data containing only de-identified, non-personal information that we may use for purposes such as to publish reports or improve our Services
• To find and prevent fraud, security threats, and abuse, and respond to trust and safety issues that may arise
• For compliance purposes, including enforcing our Terms of Service or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency
• For other purposes for which we provide specific notice at the time the information is collected

How We Disclose the Information We Collect

We do not disclose information we collect from or about users or customers except as described below or otherwise disclosed to you at the time of the collection.

Affiliates. We may disclose any information we receive to our affiliates for any of the purposes described in this Privacy Policy.

Vendors and Service Providers. We may disclose any information we receive to vendors and service providers retained in connection with the provision of our Services, such as cloud infrastructure providers, customer support platforms, and communication tools.

Analytics Partners. We use analytics services to collect and process certain analytics data. These services are only loaded after you provide cookie consent. The specific analytics and tracking technologies we use include:

• Segment — a customer data platform that collects website usage data and routes it to our other analytics tools. Segment may collect your IP address, browser type, pages visited, and interaction data. Learn more at https://segment.com/legal/privacy/.
• Google Analytics — collects and processes website analytics data, including page views, session duration, and user interactions. Google Analytics is loaded as a Segment destination. Visitor Identification Partners. We use visitor identification services to help us understand which companies are visiting our website. These services are only loaded after you provide cookie consent. They may collect your IP address and use it to identify the company or organization associated with your visit. Specifically:

• Rb2b — a visitor identification service that uses IP and browser data to identify business visitors. Learn more at https://www.rb2b.com/privacy-policy.

Visual Effects. We use Unicorn Studio, a third-party WebGL rendering service, to display visual effects on our website. When loaded (after consent), this service fetches assets from its servers (hosted on storage.googleapis.com and cdn.jsdelivr.net), which may expose your IP address. Advertising Partners. We work with third-party advertising partners to show you ads that we think may interest you. If you do not wish to receive personalized ads, you can manage your preferences through our cookie consent prompt, industry opt-out tools, or your browser settings.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others' rights, property, or safety. Your Choices

Marketing Communications. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt out of receiving promotional messages from us, you will continue to receive administrative messages from us regarding your account and our Services.

Cookies and Tracking Technologies. When you first visit our website, we present a cookie consent banner. No third-party analytics, advertising, visitor identification, or visual effects technologies are loaded until you affirmatively consent by clicking "Accept." You can reset your cookie preferences at any time by clearing the nuon_consent cookie through your browser settings. Do Not Track. There is no accepted standard on how to respond to Do Not Track signals, and we do not respond to such signals.

Third Parties

Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third-party services or any information you disclose to these third parties. Security

We make reasonable efforts to protect your information by using physical and electronic safeguards designed to improve the security of the information we maintain. However, because no electronic transmission or storage of information can be entirely secure, we can make no guarantees as to the security or privacy of your information.

Children's Privacy

We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Service is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at team@nuon.co.

International Visitors

Our Services are hosted in the United States, and our current customers are located in the United States. However, our website and platform are accessible to visitors worldwide. If you choose to use the Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the U.S. for storage and processing. We may also transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. By providing any information, including personal information, on or to the Services, you consent to such transfer, storage, and processing.
